More about this exclusive webinar:

One would expect that by getting parties together around the same table, a battle is half won already!

With mediation the aim would be to identify shared viewpoints, explore how positions might differ and overlap in an attempt to obtain a greater understanding of how these different positions might be moved forward.

The challenge of mediation lies in the finding of solutions and agreement between parties in instances where there is often a big variance in world views and values.

In this webinar the host will take you through a brief overview of recent developments within the South African context and the practical implications thereof for legal practitioners within the traditional litigation context.

Session 1: 60 minutes

  1. The emergence and rise of mediation within the South African context.
  2. A fresh take on traditional litigation systems.
  3. The “multi-door courthouse” phenomenon.

Session 2: 60 minutes

  1. A practical approach to the “multi-door courthouse” phenomenon.
  2. The role and function of the legal practitioner within the mediation milieu.
  3. Mediation etiquette and preliminary preparatory procedures – “the do’s and don’ts of mediation”.
  4. An explanatory note on the information pack, forms and some precedents.

Session 3: 20 minutes

  1. Q & A Session
